These Terms of Service ("Terms") are a contract between you and Healthx.life ("we", "us"), the operator of FitAI, governing your use of fitai.live, our iOS and Android apps, and all related services (together, the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old to use FitAI. By using the Service you represent that you meet this requirement and that the information you provide is accurate.
2. Your account
- You are responsible for safeguarding your password and for all activity under your account.
- Sign in with Google or Apple if you prefer — the same terms apply.
- Notify us at support@healthx.life if you suspect unauthorized access.
- We may suspend or terminate accounts that violate these Terms.
3. Not medical advice — important
FitAI provides general wellness, fitness, and nutrition information powered by AI. It is not a medical device, not a diagnostic tool, and not a substitute for professional medical advice.
- Always consult a qualified healthcare provider before starting a new fitness or nutrition program, especially if you have a medical condition, are pregnant, or are recovering from injury.
- If you think you may have a medical emergency, call your local emergency number immediately.
- AI-generated responses can be inaccurate or incomplete. Verify anything safety-critical with a professional.
4. What you can and cannot do
You may use the Service for personal, non-commercial wellness purposes. You may not:
- Use the Service in any way that violates applicable law.
- Reverse engineer, scrape, or attempt to extract source code or training data.
- Abuse, overload, or attempt to disrupt the Service or its infrastructure.
- Impersonate another person or misrepresent your identity.
- Use the Service to collect or process medical, protected health, or other regulated data for third parties.
- Upload content that is illegal, harmful, infringing, sexually explicit, or that targets minors.
- Use automated systems to interact with the Service at a volume that impairs availability for others.
5. User content
You keep ownership of the content you submit to FitAI (profile info, photos, chat messages, journal entries, etc.). You grant us a worldwide, non-exclusive, royalty- free license to store, process, and display your content only to provide and improve the Service for you. We do not use your content to train third-party AI models.
6. AI-generated content
Responses from the AI assistant, generated workouts, meal plans, and wellness tips are produced by Google Gemini and our prompt pipeline. These outputs are provided as-is. You are responsible for using your judgment and consulting professionals before acting on any AI output.
7. Subscriptions, billing, and cancellation
FitAI offers a free plan and an optional Premium subscription.
- Plans & pricing. Premium is offered as a Monthly or Yearly auto-renewing subscription that unlocks unlimited AI features and premium tools. The current price, billing period, and any free-trial terms are shown in the app at the time of purchase. The free plan remains available and is supported by ads.
- Purchases happen in the mobile apps. Premium is sold only through the Apple App Store and Google Play from within our iOS/Android apps. There is no purchasing on the website.
- Auto-renewal. Your subscription renews automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your Apple or Google account is charged within 24 hours before the period ends.
- Free trial. If a free trial is offered, it automatically converts to a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends. If you subscribe during a trial, any unused portion of the trial is forfeited once the paid subscription begins.
- Manage or cancel. Manage or cancel anytime in your store account settings — App Store: Settings → your name → Subscriptions; Google Play: Play Store → Subscriptions. Deleting the app does not cancel your subscription. Cancellation takes effect at the end of the current billing period, and you keep Premium until then.
- Refunds. All payments are processed by Apple or Google. Refunds are handled by them under their policies; we cannot directly issue refunds for store purchases (App Store: reportaproblem.apple.com; Google Play: the Play Store refund process).
- Price changes. We may change subscription prices. Changes apply to future billing periods only, and where required we or the app store will notify you and obtain any consent needed before they take effect.
8. Availability and changes
We work hard to keep the Service available, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time. We will try to give reasonable notice of material changes.
9. Privacy
Your use of the Service is also governed by our Privacy Policy. Please read it to understand how we collect and use your data.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEALTHX.LIFE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF USD 100 OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.
12. Indemnity
You agree to defend and indemnify Healthx.life against claims arising from your misuse of the Service, your violation of these Terms, or your violation of another person's rights.
13. Termination
You can delete your account at any time from Settings → Delete Account. We may suspend or terminate your access to the Service immediately if you violate these Terms. On termination, sections 5–12 survive.
14. Governing law and disputes
These Terms are governed by the laws of India. Any dispute will be brought exclusively in the competent courts of Ahmedabad, Gujarat, India, except where applicable consumer protection law grants you the right to sue in your place of residence.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced in the app and via email. Continued use of the Service after changes take effect means you accept the updated Terms.
